Terms of Use — Waterfall Sounds

These Terms govern your use of the Waterfall Sounds iOS app ("the App") published by Erbacci Ltd. By installing or using the App, you accept these Terms.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on iOS devices you own or control, for personal, non-commercial use, subject to Apple's Licensed Application End User License Agreement (Apple Standard EULA), which applies in addition to these Terms.

2. Subscriptions and Free Trial

• The App offers an auto-renewable subscription, "Premium Monthly", which unlocks premium audio tracks and features.
• Eligible users may receive a 7-day free trial. Unless cancelled at least 24 hours before the trial ends, the subscription auto-renews at the standard monthly price.
• Payment is charged to your Apple ID at confirmation of purchase. Subscriptions auto-renew until cancelled in your Apple ID account settings.
• Manage or cancel at any time from Settings → [your name] → Subscriptions on iOS.
• Refunds are handled by Apple per their refund policy.

3. Free content vs Premium

The App offers a selection of free tracks and a larger Premium catalog. Premium tracks are available only with an active subscription.

4. Acceptable use

You agree not to: (a) reverse engineer or extract the audio assets, (b) redistribute, resell, or rebroadcast App content, (c) use the App in any unlawful way, (d) attempt to bypass subscription validation.

5. Intellectual property

All audio recordings, artwork, code, and trademarks in the App are owned by Erbacci Ltd or its licensors and protected by copyright and other laws.

6. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied. Waterfall Sounds is not a medical device and is not intended to diagnose, treat, cure, or prevent any condition. If you have a sleep disorder or other medical condition, consult a qualified professional.

7. Limitation of liability

To the maximum extent permitted by law, Erbacci Ltd shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising out of your use of the App.

8. Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time and cancel your subscription via Apple.

9. Changes to Terms

We may update these Terms from time to time. Material changes will be announced in-app or on this page with a new "Last updated" date. Continued use after changes constitutes acceptance.

10. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict of laws principles, except where applicable consumer law provides otherwise.
